These General Terms and Conditions of Services (the “Terms”) govern the booking and participation in sailing trainings, sailing trips, regattas and related services offered by WIND RISES WATER SPORTS TRAINING SERVICES L.L.C., a company registered in Dubai, United Arab Emirates, with its registered office at AL KHABEESI BUILDING PLOT 128-246 - G-02, Trade License No. 1118837 (the “Service Provider”, “we”, “us” or “our”).
These Terms apply to all bookings made through the website https://dubai.windrises.com/ and to participation in any event, activity or service offered by the Service Provider.
By booking, registering for or participating in any sailing activity organized by us (each an “Event”), you confirm that you have read, understood and agreed to be bound by these Terms and by our Privacy Policy. If you do not agree with these Terms, you must not book or participate in our services. If you make a booking on behalf of another person or a group, you represent that you are authorized to do so and that you have informed each participant of these Terms and any applicable safety requirements.
1.1 The Service Provider provides sailing trainings, recreational sailing sessions, regattas, educational sailing activities and related maritime experiences conducted on sailing yachts or other vessels operated by or on behalf of the Service Provider.
1.2 Descriptions of Events, including dates, locations, duration, eligibility requirements and prices, are provided on the website or communicated during the booking process. Due to the nature of sailing and maritime operations, certain operational details may change depending on weather conditions, sea state, vessel availability, marina access, instructor availability, safety considerations and other practical circumstances. All Events are therefore offered subject to availability and subject to the Service Provider’s ability to conduct them safely and reasonably.
2.1 A contract between you and the Service Provider is formed when you submit a booking, registration or order request through the website or otherwise request to join an Event, and we accept that booking by confirming your participation and receiving the applicable payment in accordance with the payment terms communicated for the relevant Event. In some cases, confirmation may be issued automatically through the website or payment system, and in other cases it may be sent manually by email, message or other communication. We reserve the right to refuse a booking request before confirmation where an Event is full, operationally unavailable, unsuitable for the participant, or where we reasonably believe that participation would be unsafe or otherwise inappropriate.
2.2 The contract is concluded electronically. No separately signed written agreement is required unless we expressly agree otherwise in writing. The governing language of these Terms is English. If any translated version is provided for convenience, the English version shall prevail to the extent permitted by law, although we may provide consumer-facing information in other languages where appropriate. A booking may only be made by a person who is legally capable of entering into a binding agreement, or by a parent, guardian or other duly authorized person acting on behalf of a participant where such arrangement is permitted for the relevant Event.
3.1 When making a booking, you must provide accurate, complete and current information, including your name, contact details and any other information reasonably requested for operational or safety purposes. You are responsible for ensuring that the information you provide is correct and for notifying us promptly of any change prior to the Event. We are entitled to rely on the information provided by you and are not responsible for losses, delays, inability to participate or other consequences arising from incorrect, incomplete or outdated information supplied at the time of booking or thereafter.
3.2 If you book on behalf of another participant, you remain responsible for ensuring that the information submitted for that participant is accurate and that the participant is aware of and agrees to comply with these Terms and any related safety rules, waivers or declarations. We may require all participants, including those booked by another person, to complete their own health declaration, liability waiver or acknowledgment of risk before taking part in the Event.
4.1 Prices for Events are published on the website or communicated during the booking process. Prices may vary depending on the type of Event, season, group size, vessel type, duration and promotional offers.
4.2 Unless otherwise stated, a booking is secured only once the required payment has been received.
4.3 The Service Provider may change prices at any time before a booking is confirmed. Once payment has been received and the booking confirmed, price changes will not affect that booking.
4.4 Payments may be made by bank card, bank transfer or other payment methods accepted by the Service Provider. Applicable VAT and other taxes may be charged in accordance with UAE law.
5.1 By booking or participating in an Event, you represent and warrant that you are physically and mentally fit to take part in sailing and water-based activities, and that you do not have any illness, injury, medical condition, impairment or other circumstance that would make your participation unsafe for yourself or for others. You further confirm that you are able to swim at a level reasonably appropriate for participation in the relevant Event, unless the particular Event is expressly described as suitable for non-swimmers under controlled conditions and we have expressly agreed to your participation on that basis.
5.2 Unless a specific Event expressly allows participation by minors, our Events are intended for adults aged 18 or over. Where minors are permitted to participate, they may do so only subject to our prior approval and only if all required parental or guardian consents, health declarations, waivers and acknowledgments are properly completed in advance. A parent or legal guardian remains responsible for the minor’s compliance with these Terms, with all safety instructions and with any event-specific conditions that may apply.
5.3 You must not participate in any Event while under the influence of alcohol, drugs, medication or any substance that may impair judgment, coordination, awareness or safe behavior. We reserve the right to refuse participation or remove you from an Event if we reasonably believe that you are intoxicated, medically unfit, excessively fatigued, unable to follow instructions, or otherwise not in a condition suitable for safe participation.
6. Health disclosures and medical responsibility
6.1 You are solely responsible for assessing your own fitness to participate. We do not provide medical advice, and if you have any uncertainty regarding your health, physical condition, pregnancy, injury history, disability, medication, allergy or any other factor that may affect your participation, you should seek independent medical advice before booking or attending the Event. You must disclose to us, before the Event begins, any medical condition or special circumstance that may affect your safety or the safety of others.
6.2 We may refuse or discontinue your participation if we reasonably believe that the Event is unsuitable for you from a health or safety perspective, even if you have already booked and attended. This is not intended as a medical assessment but as an operational and safety judgment made in the interests of all participants. If urgent circumstances arise during an Event and we reasonably believe that medical attention is required, you authorize us to seek emergency assistance on your behalf. We do not provide medical insurance, and any resulting treatment, transportation or related costs may be your responsibility.
6.3 Sailing involves vessel movement and sea conditions that may cause discomfort, seasickness or fatigue, particularly for individuals with limited sailing experience. You are responsible for assessing your own tolerance for such conditions and for taking appropriate precautions, including medication if recommended by a medical professional. Experiencing seasickness or discomfort during an Event does not constitute grounds for cancellation, refund or compensation. Participants who feel unwell during sailing should immediately inform the captain so that appropriate assistance may be provided.
7.1 You acknowledge that sailing, open water training, yacht-based activities and related water sports inherently involve risk. These risks may arise from environmental conditions, equipment, vessel movement, physical exertion, emergency maneuvers, changing weather, waves, heat, water exposure, human error, the acts or omissions of other participants, and other known or unknown circumstances. The risks include, without limitation, slipping, falling, impact injuries, rope burns, entanglement, boom strike, winch or rigging injuries, collision, capsize, immersion in water, man overboard situations, delayed rescue, dehydration, sun exposure, panic, exacerbation of existing medical conditions, serious bodily injury, property loss and, in extreme cases, disability or death.
7.2 By choosing to participate, you voluntarily accept these inherent risks to the fullest extent permitted by law. You understand that although safety rules, supervision, proper equipment and good seamanship significantly reduce risk, no sailing or water-based activity can be made completely risk-free. Your participation is therefore at your own risk, subject always to any non-excludable rights or remedies available to you under applicable law.
7.3 Before participation, we may require you to sign a separate waiver, acknowledgment of risk, release of liability, parental consent, medical declaration or similar document. Where required, participation is conditional upon signing such document in the form requested by the Service Provider.
8.1 Prior to participating in any Event, you must familiarize yourself with our safety rules (Appendix 1) and Boating Safety Guide provided by the Government of Dubai (https://pcfc.ae/en/DMA/Marine%20Guides/Boating%20Safety%20Guide.pdf). By participating in an Event, the participant confirms that they have read, understood and agreed to comply with all safety rules and instructions provided by the Service Provider. Participants acknowledge that these rules are designed to ensure the safety of all persons on board and to protect the vessel and equipment from damage. The Service Provider may conduct a safety briefing before the start of an Event. Attendance at such briefing and compliance with the instructions given during it are mandatory. Participants who fail to attend the safety briefing or who refuse to comply with safety instructions may be refused participation in the Event without refund. Participants are responsible for acting with reasonable care, maintaining awareness of their surroundings on board the vessel, and immediately informing the captain or instructor if they feel unwell, unsafe or unable to continue participation.
8.2 You are responsible for wearing suitable clothing and footwear for sailing and for the weather conditions expected on the day of the Event. We may refuse participation to anyone wearing unsafe footwear or otherwise unsuitable clothing. You must immediately inform the captain/instructor if you feel unwell, injured, unable to continue, or concerned about your own safety or the safety of others. Aggressive, abusive, reckless, disruptive or otherwise inappropriate behavior is not permitted. We may intervene at any time if necessary for safety, order or proper conduct of the Event.
9.1 Because sailing depends on factors outside our full control, we may need to change the date, time, departure point, route, vessel, instructor, group composition, training format, duration or other operational aspects of an Event. Such changes may be required due to weather, sea conditions, wind strength, technical or mechanical issues, local authority restrictions, marina access, safety concerns, staffing needs, or other circumstances that make the original arrangement unavailable, unsafe or commercially impracticable.
9.2 For operational and safety purposes, wind strength measured at 6 points or higher on the Beaufort scale may be considered unsafe for group training sessions or recreational sailing activities, particularly where participants have limited sailing experience. In such circumstances the Service Provider may postpone or cancel the Event, even if sailing may still technically be possible for experienced sailors. Where an Event cannot be conducted due to unsafe weather conditions, the participant will normally be offered either rescheduling to another available date or a refund of the amount paid for the affected Event.
9.3 We do not guarantee any particular route, vessel configuration, instructor, weather condition, sea state or training result. If a change is necessary, we will use reasonable efforts to notify you as early as practicable and to provide a suitable alternative, a rescheduled date, a credit or a refund, depending on the circumstances and as provided in these Terms. The fact that conditions on the day are different from your personal expectations does not by itself mean that the service has been improperly provided, particularly where the Event proceeds safely and substantially in line with its nature and purpose. Decisions regarding weather safety are made by the Service Provider and the captain of the vessel based on professional judgment, local conditions and safety considerations. Such decisions are final and are taken solely in the interest of participant safety and responsible maritime operation.
10.1 Places in sailing trainings and group sessions are limited, and when a booking is made we commit operational resources, reserve a slot, allocate staff time and often arrange vessel capacity in reliance on that booking. For that reason, cancellations and rescheduling requests are subject to timing and availability. Unless otherwise expressly stated for a particular Event, a participant may cancel a group training free of charge up to 72 hours before the scheduled start time and may choose either a full refund of the amount paid or rescheduling to another available slot, subject to availability and reasonable operational constraints.
10.2 If you cancel less than 72 hours before the scheduled start time, the booking fee is ordinarily non-refundable, because the reserved place and associated operational costs cannot usually be recovered at short notice. However, where you provide documentary evidence of illness, injury or another serious circumstance preventing participation, we may, in our discretion, offer a refund, a credit or a one-time rescheduling. Any such accommodation is made on a case-by-case basis and does not create a general waiver of the cancellation rules.
10.3 If you wish to reschedule rather than cancel, we may allow rescheduling up to 48 hours before the scheduled start time, subject to availability and subject to a reasonable administrative fee, which for group trainings may be set at 10% of the booking price unless otherwise specified. If you fail to attend, arrive too late to participate safely, or are unable to participate because you lack proper documents, suitable clothing, necessary fitness, sobriety or required disclosures, your booking may be treated as a no-show and may be non-refundable.
10.4 Nothing in this section is intended to deprive you of any non-waivable right to a refund, re-performance or other remedy under applicable law where we cancel the Event, fail to provide the booked service, materially fail to provide the service as described, or where any mandatory consumer protection rule requires a different result.
11.1 We may postpone, suspend, interrupt or cancel an Event before or after it begins if we reasonably consider this necessary due to weather, sea state, wind conditions, technical or mechanical issues, force majeure, local authority restrictions, port or marina limitations, safety concerns, the conduct or fitness of a participant, or any other circumstance making the Event unsafe, impracticable or commercially unreasonable to continue. Sailing is highly sensitive to changing operational conditions, and decisions made by the captain or Service Provider for safety reasons are final.
11.2 If we cancel an Event before it begins, you will ordinarily be offered either a rescheduled date or a refund of the amount paid for the cancelled Event. If an Event has already started and must be shortened, interrupted or materially modified due to operational or safety reasons, we may, depending on the extent of services already provided and the nature of the interruption, offer a partial refund, a credit, a rescheduling option or no refund. In assessing what is fair and appropriate, we may consider whether the core purpose of the Event has already been substantially fulfilled. We are not responsible for travel, accommodation, transport, visa, time-off or other personal expenses incurred by you in connection with a postponed, interrupted or cancelled Event.
12.1 We reserve the right, at any time and with immediate effect, to refuse participation in, suspend or remove a person from an Event if that person breaches these Terms, ignores safety rules, behaves dangerously or disruptively, is under the influence of alcohol or drugs, is physically unable to participate safely, endangers the vessel or other participants, or fails to comply with the lawful instructions of the captain/instructor. This right is essential to the safe operation of sailing activities and to the protection of all persons on board and around the vessel.
12.2 Where a participant is refused or removed for reasons attributable to that participant, no refund, compensation or reimbursement is ordinarily due, and the participant is responsible for any personal arrangements and expenses arising from the refusal or removal, including transportation from the marina or return travel. We may also refuse future bookings from a participant whose past conduct gives rise to legitimate safety or operational concerns.
13.1 You must treat the vessel, equipment, marina facilities, training materials and any other property used in connection with the Event with due care and in accordance with instructions. If you cause damage through your act, omission, negligence, recklessness, misconduct or breach of instructions, you may be liable for the resulting losses, including repair costs, replacement costs, cleaning costs, loss of use, downtime, owner claims and other direct losses reasonably arising from the damage. We may document the damage, obtain repair quotations or rely on owner assessments, invoices or other reasonable evidence in determining the amount payable.
13.2 If you cause harm to another participant, third party or their property through wrongful conduct, you remain personally responsible for such conduct to the extent provided by law. Nothing in these Terms obliges us to assume liability for damage caused by you to others merely because the Event was organized by us.
14.1 To the fullest extent permitted by applicable law, we shall not be liable for injury, illness, death, property loss, property damage, delay, disappointment, inconvenience or other loss arising from the inherent risks of sailing and water sports activities, from your own acts or omissions, from your failure to follow instructions or safety rules, from inaccurate information supplied by you, from acts or omissions of third parties not under our reasonable control, from force majeure, from weather or sea conditions, or from regulatory or operational restrictions affecting the Event. We are also not liable, to the fullest extent permitted by law, for loss of enjoyment, loss of opportunity, loss of profit, travel costs, accommodation costs or other indirect or consequential losses.
14.2 Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law. In particular, nothing is intended to exclude liability for fraud, wilful misconduct, gross negligence or any other liability that cannot lawfully be excluded. Where liability cannot be excluded but may be limited, our total aggregate liability in connection with the relevant Event shall not exceed the amount actually paid by you for that Event.
15.1 During Events, we may take photographs, video recordings and other media for operational, documentary, promotional and marketing purposes. By participating in an Event, you grant us a non-exclusive, worldwide, royalty-free right to use, reproduce, publish, display and distribute photographs and recordings in which you appear, together with your image, likeness and voice, for website content, social media, editorial use, advertising, promotional campaigns and other business-related purposes.
15.2 If you do not wish to appear in promotional materials, you should notify us in writing before the Event. We will use reasonable efforts to honor such request, but we cannot guarantee that you will not appear incidentally in background or group footage where filming or photography takes place in a live event setting. Where minors are involved, parental or guardian consent may be required before any such use is made beyond incidental operational or documentary capture.
16.1 All content on our website and all materials made available in connection with our Events, including without limitation text, graphics, photographs, branding, logos, videos, course materials, documents, schedules, written guidance and other content, are owned by or licensed to us and are protected by intellectual property laws. You may not reproduce, copy, republish, distribute, modify, adapt, upload, transmit or otherwise use such content without our prior written consent, except for your own personal, non-commercial use strictly connected with your participation in an Event.
16.2 Use of our website does not grant you any right, title or interest in our intellectual property or in any third-party materials made available through the website or in connection with an Event. We reserve all rights not expressly granted under these Terms.
17.1 We process personal data in accordance with our Privacy Policy and applicable law. By submitting personal data in connection with a booking or Event, you confirm that the information is accurate and that you are entitled to provide it. Also you agree to the processing of personal data by the Service Provider for the purposes described in these Terms and in the Privacy Policy. You agree to the transfer of personal data outside the United Arab Emirates, including to jurisdictions that may not provide the same level of data protection as the participant’s country of residence, where such transfer is necessary for the performance of the contract or for the operation of the Service Provider’s services.
17.2 If you submit personal data relating to another person, you are responsible for ensuring that the relevant person has been informed of the processing of their data and of the applicable terms governing participation. 17.2 By booking an Event or providing personal information, the participant agrees to the processing of personal data by the Service Provider for the purposes described in these Terms and in the Privacy Policy.
17.3 We may communicate with you by email, phone, messaging applications, website notices or other reasonable means in connection with your booking, the operation of an Event, safety matters, payment, customer service, follow-up information and, where permitted by applicable law, promotional communications relating to our services. You are responsible for ensuring that your contact details remain accurate and that you review communications sent to you in a timely manner.
18.1 We shall not be responsible for delay, non-performance, interruption, rescheduling, modification or cancellation of an Event where such outcome results from events beyond our reasonable control. These include, without limitation, severe weather, storms, strong winds, unsafe sea conditions, natural disasters, fire, flood, epidemic, pandemic, war, civil unrest, labor disruption, governmental action, authority orders, navigation restrictions, marina closure, infrastructure failure, or technical failure caused by external events. For sailing operations, weather and sea conditions that make navigation or training unsafe shall be treated as a valid basis for postponement, interruption or cancellation whether or not they are formally classified as force majeure under general law.
19.1 We may amend these Terms from time to time by publishing an updated version on the website. The version in force at the time of your booking will generally apply to that booking unless the amended version is required by law or does not materially and adversely affect your rights. Continued use of our services after an updated version has been published may constitute acceptance of the revised Terms to the extent permitted by law and by the nature of the services being used.
20.1 These Terms, and any dispute, claim or matter arising out of or in connection with them, their subject matter or formation, shall be governed by the laws of the United Arab Emirates and, where applicable, the laws and regulations in force in the Emirate of Dubai.
20.2 Any dispute that cannot be resolved amicably shall be submitted to the competent courts of Dubai, United Arab Emirates, unless mandatory law requires otherwise.
21.1 If any provision of these Terms is found to be invalid, illegal or unenforceable, the remaining provisions shall continue in full force and effect to the extent possible. A failure by us to enforce any provision shall not be treated as a waiver of that provision or of any other right.
21.2 These Terms constitute the entire agreement between you and us in relation to the relevant booking or Event, unless supplemented by a separate written agreement or by event-specific terms expressly incorporated into the booking. A printed copy of these Terms may be provided on request, but the electronic version published by us shall remain controlling unless otherwise agreed in writing.
Appendix 1 to the General Terms and Conditions
These Rules form an integral part of these General Terms and Conditions. Compliance with these rules is mandatory for all persons attending sailing training.

By participating in an Event, you confirm that you have read, understood and agree to comply with the rules set out below.
When boarding a yacht, you must be aware of the risks and the most significant hazards associated with sailing and must follow the personal and collective safety rules described below. Compliance with these rules does not eliminate all risks and does not replace the need for basic caution, awareness and common sense. Minors must comply with all safety requirements, and their parents or legal guardians remain responsible for ensuring such compliance.
Falling overboard is one of the most serious dangers on a yacht. When the yacht is under way, you must remain in the safe area — the cockpit — at all times. Leaving the cockpit without the permission and supervision of the helmsman is strictly prohibited.
When moving on deck, always keep in mind that the sails may suddenly swing to the opposite side. Move carefully, keeping your head below the lower edge of the sails. When working on the foredeck, remain on the inside of both headsail sheets.
Ropes and rigging on the deck and in the cockpit also present a hazard. Stepping on a round rope can easily cause you to slip. Sailcloth is also very slippery, so stepping on sails should be avoided whenever possible.
A life jacket must be worn before entering the water area. The life jacket may only be removed with the permission of the captain. Non-swimmers (persons who cannot swim 100 meters freestyle in a swimming pool without stopping) must keep their life jacket on at all times while on deck and outside the interior of the yacht.
The boom (the horizontal aluminum spar attached to the lower edge of the mainsail) can move suddenly and presents a serious danger, particularly when sailing downwind.
Whenever you are in the area where the boom may swing, you must stay below its level. If you hear the command “Boom!”, immediately duck down toward the deck. You should also warn other crew members who may be standing in the danger zone.
When on deck, you must wear proper deck shoes that provide reliable grip on wet surfaces. Shoes must fully cover your feet and toes.
Crocs, flip-flops, sandals, open-toe shoes, heelless shoes, high heels, platform shoes or shoes with slippery plastic soles are unsafe and may lead to injuries or falling overboard.
When moving around the deck while the yacht is under way, follow the mountaineering principle of three points of contact: at any moment you should maintain three points of support.
Always hold on to secure, fixed structures such as the standing rigging (shrouds and stays), lifelines or railings. Never hold on to running rigging (moving ropes).
When going below into the cabin, always face the ladder in order to avoid falling backward.
Rigging should only be handled while wearing appropriate gloves.
Take up slack in a line either through a cleat or by placing two or three turns around the winch, depending on the load. When easing or trimming a line through a winch, keep your hands at least 30–40 cm away from the winch drum.
Exercise caution when working with cleats and other deck hardware. Never wrap ropes around your hands or any part of your body.
The first person who sees someone fall overboard must loudly shout “Man overboard!”
If the person who fell overboard is not wearing a life jacket, throw them a life jacket or any floating object to help them stay afloat.
The captain (helmsman) must immediately assign a spotter whose task is to continuously watch the person in the water and indicate their position by pointing with an outstretched arm. This is important because crew members involved in maneuvering the yacht may lose sight of the person in the water. The spotter’s outstretched arm serves as a reliable reference.
Recovery of the person overboard should be performed from the stern of the yacht. The yacht must approach the person in the water at low speed, and the person should remain on the leeward side of the vessel.
Prepare a boat hook and a lifeline (rope) to assist in the recovery.
If you fall overboard, do not panic. Take a deep breath and try to stay calm. If you are not wearing a life jacket and no floating object has been thrown to you, or if such objects drift away with the wind, and swimming becomes difficult, remove heavy clothing such as jackets or waterproof gear and heavy shoes or boots. However, if you are able to stay afloat comfortably while wearing your clothes — especially in cold water — it may be better to keep them on, as clothing and footwear, even when wet, can help retain body heat and reduce the risk of hypothermia.

I understand that sailing and maritime activities involve inherent risks that cannot be completely eliminated. By participating in activities organized by WIND RISES WATER SPORTS TRAINING SERVICES L.L.C., I voluntarily acknowledge and accept these risks.
I confirm that I am physically and mentally capable of participating in sailing activities and that I do not have any medical condition, injury or impairment that would make my participation unsafe for myself or others. I understand that the Service Provider does not provide medical insurance for participants and that I am responsible for my own health condition and insurance coverage where applicable.
I confirm that I have read or have been informed of the safety rules and operational guidelines applicable to the Event and that I have had the opportunity to ask questions before participation. I agree to comply with all safety instructions given by the captain/instructor. I understand that failure to follow safety rules may result in my removal from the Event without refund. I acknowledge that all sailing activities are conducted under the authority of the vessel’s captain and that the captain has full discretion regarding navigation, safety procedures and operational decisions. I agree to follow all instructions given by the captain and understand that such decisions are final and are made solely in the interest of safety.
I acknowledge that the Service Provider may collect and process my personal data, including identification details and contact information, for purposes related to event administration, safety management and operational organization. I agree to the processing of my personal data and to the transfer of my personal data outside the United Arab Emirates, including to jurisdictions that may not provide the same level of data protection as my country of residence, where such transfer is necessary for the operation of the Service Provider’s services.
To the fullest extent permitted by applicable law, I acknowledge that the Service Provider shall not be liable for injuries, losses or damages arising from the inherent risks of sailing activities. Nothing in this waiver excludes liability that cannot be excluded under applicable law, including liability for fraud, wilful misconduct or gross negligence.

I understand that sailing and maritime activities involve inherent risks that cannot be completely eliminated. By allowing the minor named above to participate in activities organized by WIND RISES WATER SPORTS TRAINING SERVICES L.L.C., I acknowledge and accept these risks on behalf of the minor.
I confirm that, to the best of my knowledge, the minor is physically and mentally capable of participating in sailing activities and does not have any medical condition, injury or impairment that would make participation unsafe for the minor or for others. I understand that the Service Provider does not provide medical insurance for participants and that I am responsible for the minor’s health condition and insurance coverage where applicable.
I confirm that I have read or have been informed of the safety rules and operational guidelines applicable to the Event and that I have had the opportunity to ask questions before the minor’s participation. I confirm that the minor will comply with all safety instructions given by the captain/instructor. I understand that failure to follow safety rules may result in the minor being removed from the Event without refund. I acknowledge that all sailing activities are conducted under the authority of the vessel’s captain and that the captain has full discretion regarding navigation, safety procedures and operational decisions. I confirm that the minor will follow all instructions given by the captain and understand that such decisions are final and are made solely in the interest of safety.
I acknowledge that the Service Provider may collect and process personal data relating to the minor and to me as parent or legal guardian, including identification details and contact information, for purposes related to event administration, safety management and operational organization. I agree to the processing of such personal data and to the transfer of personal data outside the United Arab Emirates, including to jurisdictions that may not provide the same level of data protection as the country of residence, where such transfer is necessary for the operation of the Service Provider’s services.
To the fullest extent permitted by applicable law, I acknowledge that the Service Provider shall not be liable for injuries, losses or damages arising from the inherent risks of sailing activities. Nothing in this waiver excludes liability that cannot be excluded under applicable law, including liability for fraud, wilful misconduct or gross negligence.
I confirm that I have read and understood this waiver and that I have had sufficient opportunity to review it before signing.
